Custom Computer 1-Year Limited Warranty

This Warranty sets out the terms and conditions on which OMIT, Inc. (Office Mate International Technologies, Inc., "OMIT") will or will not perform warranty service related to Titan, Tytannia, or GranIT computer products (namely at the time of this printing: Titan, TitanHT, Tytannia, GranIT and GranIT Rackmount models). Within this document: "OMIT" refers to Office Mate International Technologies and its affiliate companies; "Factory" refers to OMIT's manufacturing facilities; "User" refers to the initial purchaser of the equipment, and; "Support" refers to OMIT Technical Support services.

Issues Covered by this Warranty

  1. OMIT will warrant the hardware against defects for the period of one (1) year from the date of new equipment. This warranty covers (a) system hardware for one (1) year and (b) labour for the first year after purchase. During the warranty period, if the system develops a hardware problem, contact our Technical Support department. OMIT will repair or replace any defective components with new parts, or with serviceable used parts that are equivalent or superior to new parts in performance. All defective parts or exchanged parts will become the property of OMIT.

  2. Technical Support during the First Year (on new equipment only): Extended Warranty may be acquired at the time of purchase for a nominal charge.

  3. Pertaining to Tytannia Laptops: The notebook computer battery is excluded under the warranty coverage. The notebook computer battery has a three (3) month warranty coverage due to the battery being a consumable component prone to wear. The consumer should note that the LCD screen of the notebook computer may have a small number (usually up to 6) red, green, blue, bright or dark spots called "On-Pixels" that often appear on LCD screens. According to the specification from LCD manufacturers, the existence of "On-Pixels" is permissible and meets Manufacturer QA Standards. Therefore in such an instance the product does not qualify for return or replacement under warranty.

Issues NOT Covered by this Warranty

  1. Damage from misuse, abuse or neglect

  2. Damage from use of parts not sold or distributed by OMIT, Inc.

  3. Damage resulting from direct or indirect user modification

  4. Damage from repair by unauthorized, inexperienced or uncertified persons

  5. Damage to data, or loss of data, and/or damage to customer installed programs

  6. Expendable parts, such as non rechargeable batteries

  7. Cosmetic and mechanical wear

  8. Any sign of physical damage, including damage caused during transport

  9. Removal of spyware, adware, keyloggers, spam, popups, hexes, boot stubs, or similar malware agents

  10. Systems damaged by a virus, Trojans, worms, or similar viral agents

  11. Customer supplied or used components

  12. Labour beyond the first year of the Standard System Warranty

  13. Service to any device or network beyond the scope of the system(s) listed above. This includes, but is not limited to, network configuration, software*, or non-OMIT produced products

  14. Pertaining to Tytannia laptops: Any service deemed by Asus, the system OEM, that is not warrantable.

During the first year of Warranty, the product owner may elect to purchase supplemental RockSolid Extended Depot Warranty for a nominal charge.

* OMIT, Inc. makes no warranty whatsoever with respect to software included in any products sold by OMIT, Inc., and all software is sold "AS IS" and "WITH ALL FAULTS". Software applications may vary from retail versions and may not include documentation. Titles are subject to change.

Limitations

  1. You must register within 30 days of delivery to validate the Warranty.

  2. Sales receipt is required as proof of purchase.

  3. It is recommended that a complete system backup be performed immediately after your computer has been setup. Without the software and drivers, our technicians will not be able to help you. Down time due to proper system backups not being performed is not the responsibility of OMIT, Inc.

  4. If a problem develops after a program was installed, it is likely to be a software conflict.

  5. OMIT, Inc. only warrants new or factory-reconditioned, factory-installed components. Correction of customer-installed software is not covered by this warranty.

  6. A fee will be levied for virus removal. Any or all files that are damaged by a virus or lost at this time become the owner's responsibility. It is recommended that all data files be backed up before the machine is shipped for service.

  7. Software conflict due to incorrect setting: if the system is sent in and it is diagnosed as having a software conflict, a service charge will be levied.

  8. No repair, or replacement of components whole or in part shall extend any warranty.

During the warranty period, if a problem develops, please contact our Technical department and one of our CompTIA (A+) Bonded Certified Technical Support specialists will ask you to perform a series of tests to determine whether it is a hardware or a software problem.

Service Scheduling

OMIT's Technical Service Department is available from 9:30AM to 6:00PM, Pacific Standard Time, Monday to Friday, exclusive of statutory holidays.

OMIT's Technical Service Department will provide call reception and telephone problem diagnosis assistance for warranty claims received from the customer (end user). Once diagnosis has been completed and it is found to be a hardware defect, OMIT's Technical Service Department will log the service request for repair and dispatch the call to an Authorized OMIT Technical Representative.

Customers have the choice of dropping the machine off, or shipping the machine to an OMIT Authorized Service Depot. Prior to returning product(s) to OMIT for warranty service, you must obtain a Return Merchandise Authorization (RMA) number by contacting OMIT. All RMA numbers expire after two (2) weeks or ten (10) business days. An original invoice will be required as proof of purchase.

You must ship the product to OMIT Canada for product purchases within Canada in the original packaging, prepaid and insured by you, with the RMA number clearly identified on the packaging. The product will be returned freight prepaid by OMIT. In the event of product loss or damage during shipping, the customer is responsible for insurance both ways. In the event the customer wishes the machine to be returned with insurance, a money order made payable to OMIT for the amount of your courier's insurance charges must be included when shipping the product to OMIT. If no money order is received with the shipment, the customer agrees to waive their right for insurance, and herein accepts any responsibility for any product loss or damage during shipping.

Chargeable Service

Non-Warranty coverage, Bench and On-Site Charges are set from time to time by OMIT and are subject to change without notice. Component charges are extra and will be based upon current market prices.

Any Technical Support regarding networking issues or support after expiration of the product warranty will be charged. Please read your warranty, included in the System Guide, carefully.

Chargeable service includes, but is not limited to:

  1. Reloading Hard Drive to factory specification.

  2. Correction of customer installed hardware that was not part of original system purchase or any added hardware that was not part of factory-installed hardware is not covered by this warranty. If the added hardware is found to be causing the problem these component(s) will be removed and service time will then be charged.

  3. Repair or removal of any customer installed hardware components or software.

  4. Any virus, adware, malware or program removal.

  5. Any operating system cleanup/installation, hardware configuration, optimization, or data recovery.

  6. Search for device drivers not supplied by product owner.

  7. Any telephone, email and remote service and service consultation.

  8. Any Technical Support regarding networking issues.

  9. Any support after the expiration of the OMIT product warranty.

  10. Pertaining to Tytannia laptops: Any service deemed by Asus, the system OEM, that is not warrantable.

Service Start Date

The warranty shall commence on the date of purchase of your computer and shall end on the expiration date shown on the confirmation document delivered to the customer (end user) with the computer. Any customer who wishes to purchase the OMIT RockSolid Extended Depot Warranty coverage shall be subject to all of the terms and conditions as set out herein and shall form an integral part thereof.

In no event shall the expiration date of this, or any other OMIT Warranty, coverage exceed the expiration date of the OMIT Standard On-Site Limited Warranty, the OMIT Depot Service Warranty or the OMIT RockSolid Extended Warranty period.

Additional Recommendations and Notices
  1. Please read your warranty, included in the System Guide or in the System Support CD, carefully.

  2. For your data safety, perform a backup all important data to avoid a charge and minimize data loss.

  3. If a problem develops after a program was installed, it is likely to be a software conflict.

  4. Remember to supply all device drivers and applicable software with product being serviced. This will reduce service time.

Cancellation of Warranty

The OMIT Rock Solid Extended Warranty can be cancelled within thirty (30) days of your receipt of these terms and conditions of the program by sending written notice to OMIT Canada, Inc. Attn: Administration Department. If you cancel the Warranty Agreement within thirty (30) days of your receipt of the it, OMIT will send you a full refund less the cost of claims, if any, made under this Warranty. You may not cancel this Warranty Agreement after thirty (30) days of your receipt of this Warranty. OMIT may cancel the Warranty, upon thirty (30) days written notice to the customer at the last address provided by the customer. In the event that the Warranty is terminated by OMIT for any reason other than justifiable cause or cancelled by the customer for justifiable cause, then OMIT will return to the customer a pro-rata share of the service fee for the un-expired term of the Warranty.

Limitation of Remedy

TO THE EXTENT ALLOWED BY LOCAL LAW, THE REMEDIES IN THIS WARRANTY STATEMENT ARE YOUR SOLE AND EXCLUSIVE REMEDIES. EXCEPT AS INDICATED ABOVE, IN NO EVENT WILL OMIT, INC. OR ITS SUPPLIERS BE LIABLE FOR LOSS OF DATA OR FOR DIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL (INCLUDING LOST PROFIT OR DATA), OR OTHER DAMAGE, WHETHER BASED IN CONTRACT, TORT, OR OTHERWISE. THIS LIMITATION CANNOT BE WAIVED.

OMIT Software Warranty

This Warranty sets out the terms and conditions on which OMIT, Inc. (Office Mate International Technologies, Inc.) will or will not perform warranty service related to OMIT Software Products (namely at the time of this printing: Innova, Innova Custom, Innova Backup, M1, M1: Core, Collaborate, SalesDesk, PCHelper, Caduceus, Modus, Rhombus, D-Con, and AutoUpdater).

General Coverage

OMIT warrants that the storage media used in the production of OMIT Software Products will be free from defect in materials and workmanship for 30 days from the date you acquire it. If such a defect occurs, return the media to us at and we will replace it free of charge. This remedy is your exclusive remedy for breach of this warranty. It gives you certain rights and you may have other legislated rights which may vary from jurisdiction to jurisdiction.

Limitation of Warranties and Liability

Except for the express warranty above, all Software Products are provided on an "as is" basis, without any other warranties or conditions, express or implied, including, but not limited to, warranties of merchantable quality, merchantability or fitness for a particular purpose, or those arising by law, statute, usage of trade, or course of dealing.

The entire risk as to the results and performance of the product is assumed by you. Neither OMIT nor our dealers or suppliers shall have any liability to you or any other person or entity for any indirect, incidental, special, or consequential damages whatsoever, including, but not limited to, loss of revenue or profit, lost or damaged data or other commercial or economic loss, even if we have been advised of the possibility of such damages, or they are foreseeable.

We are also not responsible for claims by a third party. Our maximum aggregate liability to you and that of our dealers and suppliers shall not exceed the amount paid by you for the product. The limitations in this section shall apply whether or not the alleged breach or default is a breach of a fundamental condition or term or a fundamental breach. Some states/countries do not allow the exclusion or limitation of liability for consequential or incidental damages, so the above limitation may not apply.
